TERMS AND CONDITIONS

American Champion Aircraft Corporation (Herein ACAC) is now accepting orders for the Super Decathlon, Scout, and Citabria Aurora, Adventure, and Explorer. A delivery position can be reserved with a deposit of $5000.00. This amount will be applied to the purchase price of the aircraft and is non-refundable.

 

The purchaser will receive an order form and be asked to specify what options he(she) wants on his(her) plane. A final price will be determined and agreed upon at that time, and the order will be signed by both the purchaser and an officer of ACAC.

 

When the delivery position reaches the assembly line, the purchaser will be asked to pay an additional $25,000.00 toward the cost of the aircraft. This installment is also non-refundable.

 

The purchaser will be notified when his(her) plane is in final paint, and told an approximate completion date. The purchaser will be notified again when it is in final testing and when to expect delivery. The purchaser has fourteen days to remit the balance, or forfeit the aircraft. Failure by purchaser to accept airplane as agreed when notified by seller forfeits the deposit as liquidated damages for breach of said acceptance and thereupon seller has the right to otherwise dispose of the aircraft with no further liability of purchaser to seller, or seller to purchaser with regard to aircraft agreement.

 

Seller will not be held liable for any delay in making delivery for any cause whatsoever; provided, however, if seller should fail to make delivery of airplane within six (6) months after promised date of delivery, purchaser shall have the right to demand return of said deposit and forfeit delivery of the aircraft.  Thus, canceling the order.

 

All terms and conditions stated in all franchise agreements between seller and purchaser shall apply in full to this order.

 

Subject to changes in standard equipment without notice, the list price of the aircraft on this order is guaranteed fixed to the extent that if the list price is increased prior to delivery, the purchaser will be notified and shall have the option of canceling this order within five business days of such notice and receiving refund of his deposit in full amount.

 

If alterations to the order are made by the purchaser after the agreement is signed, the guaranteed price will be adjusted to reflect the change in options. Also, ACAC is not liable for guaranteeing that the said changes will be made if these changes are made after the initial signed agreement. If a change is requested and not made to the aircraft upon delivery, no charge for the change will be incurred by the purchaser.

 

ACAC warrants each new aircraft and part thereof manufactured by it, together with all new equipment and accessories installed or sold by it to be free from defects in material and workmanship under normal use and service for a period of six (6) months after delivery to the original retail purchaser or first user. The obligation of ACAC under this warranty is limited to repair or replacement, at the option of ACAC of any part or parts which shall be returned within the six (6) month period, transportation charges prepaid to ACAC at Rochester, Wisconsin for the aircraft and which upon examination shall disclose to ACAC's satisfaction to have been defective. The repair or replacement of parts under this warranty will be made by ACAC at no charge for parts, removal and installation labor, and/or for repair labor. Replacements under warranty are warranted for the balance of the original warranty period.

 

Aircraft purchased from dealers local to them (in the state region allotted to the dealer by ACAC) receive twelve (12) months of warranty instead of the standard six (6) months.

 

This warranty shall not in any way apply to or cover any products which are in ACAC's opinion damaged as a result of being in any manner altered or repaired outside of ACAC's factory or which have been subject to misuse, negligence, or accident.

 

This warranty shall not apply to normal maintenance services such as cleaning, control rigging, mechanical adjustments, engine tune-up, and maintenance inspections, nor to items replaced due to use and wear, such as spark plugs, brake linings, hoses, belts, tires, and filters. Any modifications, alterations, or changes to this aircraft other than FAA Airworthiness Directives or factory approved modifications, nullifies all responsibilities and obligations for this aircraft.

 

Some equipment and accessories installed or sold by ACAC are also warranted separately by their respective manufacturers, sometimes with terms and conditions different than ACAC's warranty.

 

The above warranty provisions are expressly in lieu of all other warranties, expressed, statutory or implied in fact or by law, including any implied warranty of fitness for a particular purpose, and of any other obligation or liability on the part of ACAC, expressed or implied of any nature whatsoever. ACAC neither assumes nor authorizes any other person or business organization to assume for it any other warranty or liability in connection with such aircraft products.

 

A checkout for flight competency is mandatory.

 

The buyer(s) or the buyer's agent must sign a release and acceptance document at the time of delivery.

 

This order and conditions printed above comprise the entire agreement pertaining to this purchase and no other agreement of any kind, verbal understanding or promise whatsoever will be recognized.
